Internet Mediation
If both parties can negotiate using the written word, a dispute can be settled by using the Internet, saving travel time and money.
When is it Appropriate?
1. When contesting parties are far apart geograpically.
2. When one party is unable to travel.
3. In court-ordered cases, if both parties agree and the court does not object.
How It's Done
1. Notify the mediator that both parties agree to Internet mediation.
2. Sign a contract agreeing to mediation and to pay a negotiated fee. (The fee will depend on the contested amount and estimated time required.)
3. Both parties email or fax position papers to the mediator.
4. The mediator may ask questions via email.
5. The mediator will ask for suggested options for settlement and may himself propose options via email.
6. After all settlement options have been explored, and a settlement agreement is reached, all sign the agreement distributed by fax.
7. In court-ordered cases, the mediator notifies the judge of settlement.
