Some example situations in which mediation is called for:
1. Conflict between siblings over parent’s welfare.
2. Conflict between child and parent.
3. Conflict between family and administration of care facility.
4. Conflict between patient and staff or administration.
5. Conflict over wills, trusts, and estate.
6. Conflict over guardianship.
7. Conflict over medical decisions.
8. Conflict over relocation of elders.
9. Conflicts over restricted activities for elders, such as driving.
10. Conflicts over power of attorney and financial decisions.
None of these, or other conflicts, need go to court. If one party files a lawsuit, most courts will order the parties to mediation prior to trial to try to settle in mediation. It is far better, and much less expensive, to call in a mediator before the conflict grows.
